With foreclosures, liens and TIFs causing more litigation among their clients, HUD's Brad Geary and Latimer Levay Jurasek's Barbara Andersen presented real estate cases at a seminar yesterday morning. The verdict? Recent cases have given priority to the lender over the subcontractors in the case of limited funds in a foreclosure. They've also required that borrowers on foreclosed properties allow the court to appoint a receiver unless they can present compelling evidence that a sale is imminent. |
