Alternate Construction Defect Bills Planned
Last week, the Colorado Senate passed its version of a new construction defects law. This week, as many as four new bills might be emerging from the Colorado House to address the issue in different ways, along with other real estate related matters. The Senate bill (SB 177) would require that a majority of condo owners in a unit—rather than a majority of HOA board members, as it is now—vote to proceed with a lawsuit against a builder, the Denver Business Journal reports. It's unclear whether the Democratic House and the Republican Senate can find common ground on reforming construction defects; the current law has virtually halted condo development in the state. [DBJ]
