Locals Take Yet Another Shot At Stopping UES Condo

Upper Eastside residents vehemently opposed to a planned condominium tower in their neighborhood are making a Hail Mary effort to stop it from going ahead.

In June, the Board of Standards and Appeals ruled Gamma Real Estate's 64-story condo tower at 428-432 East 58th St., called Sutton 58, could go ahead.

The area had been rezoned, but the board found the new rules should not apply to the project, despite community members railing against the tower.

Now, a group of residents, known as the East River Fifties Alliance, is suing to stop construction, Crain’s New York Business reports.

It wants Gamma to adhere to new zoning regulations, which would restrict the building’s height. The group argues the board improperly allowed the developers to put in foundations for the tower, meaning the old zoning requirements applied. Sometimes developers building where excavation is already complete don't have to comply with a rezoning. 

At the time of the board’s ruling in June the group released a statement saying it would "take the community’s fight against this monstrous, out-of-place mega-tower to the courts and away from a city agency.”
