Ted Lerner’s Brother Helps Lord & Taylor in White Flint Mall Lawsuit
Ted Lerner’s brother is getting involved in the lawsuit between Lord & Taylor and Lerner Enterprises, but not in the way you’d think, reports Bethesda Beat. Lord & Taylor is suing Lerner Enterprises and Tower Cos, owners of White Flint Mall, claiming plans to redevelop into a mixed-use town center violate a lease agreement that stipulates landlords must operate a “first class high fashion regional shopping center.” A judge threw out an injunction in December 2013, but now Lord & Taylor is back with a vengeance, with “damaging” interview transcripts from a separate lawsuit by Lawrence Lerner against the owners of White Flint Mall. This lawsuit, filed in April 2014, claims redevelopment plans violate a 1975 partnership agreement. Lord & Taylor’s lawyers filed a subpoena for the transcripts to help support their claim that the December 2013 decision was based on false claims that the mall was further along in the development process than it actually was. This isn’t the first lawsuit between the brothers or against White Flint Mall. Last year the mall won a case involving a Dave & Buster's eviction.
