The Legal Reasoning Behind Brady's Thrown-Out Suspension
Tom Brady just seems to get his way. Where did the overturn of his four-game suspension for "Deflategate"come from? US District Judge Richard Berman concluded that the suspension ordered by NFL Commissioner Roger Goodell should be vacated because it was premised on "several significant legal deficiencies." Those include: "inadequate notice" of Brady's potential suspension and alleged misconduct; the "denial of the opportunity for Brady to examine one of two lead investigators," NFL EVP and GC Jeff Pash; and "denial of equal access to investigative files" and witness interview notes.
At the arbitration appeal hearing in late June, Paul Weiss repped the NFL and the NFLPA was repped by Winston & Strawn global antitrust/competition chair and sports law co-chair Jeff Kessler. (Above, Jeff talking NBA and NFL lockouts in '11.)
